1. Who we are
GameDesigners.online (“we”, “us”, “the Site”) is operated by GameDesigners.online, contact: [email protected]. The Site sells digital game development assets and operates a marketplace where independent creators (“Sellers”) may list their own digital products.
2. Acceptance
By accessing the Site, creating an account, or purchasing a product, you agree to these Terms. If you do not agree, do not use the Site.
3. Accounts
You are responsible for the accuracy of your account information and for all activity under your account. You must be at least 16 years old, or the age of digital consent in your country, whichever is higher. We may suspend or terminate accounts that violate these Terms.
4. Digital products and delivery
All products sold on the Site are digital. Nothing is physically shipped. After a successful payment, download links are made available immediately in your account under My Account → Downloads and are also sent to the email address used at checkout.
Download links may be limited in number of downloads and in time. If a link expires before you were able to download your purchase, contact us and we will restore access.
5. Licensing
Purchasing a product grants you a licence to use it — it does not transfer ownership or copyright. The scope of what you may do with a product is set out in our License Agreement, which forms part of these Terms. Individual Sellers may attach additional or stricter licence terms to their own products; where they do, those terms are shown on the product page and take precedence for that product.
6. Prices and payment
All prices are displayed in US Dollars (USD) unless stated otherwise. Payments are processed by our payment provider; we do not store your full card details on our servers. Applicable taxes are calculated at checkout based on your billing location and shown before you confirm payment.
7. Refunds
Because products are digital and delivered instantly, refunds are handled under our Refund Policy. Please read it before purchasing.
8. Selling on the marketplace
Sellers may apply to list products. By listing a product you warrant that you own or control all rights necessary to sell it, and that it does not infringe anyone else’s intellectual property. Commission rates, payout schedules and seller obligations are set out in the Seller Agreement. We may remove any listing at our discretion, in particular where we receive a credible infringement claim.
9. Acceptable use
You may not: resell or redistribute products outside the terms of their licence; attempt to circumvent download protection; scrape, mass-download, or reverse-engineer the Site; upload malware; or use the Site for anything unlawful.
10. Intellectual property and takedowns
If you believe content on the Site infringes your copyright, send a notice to [email protected] identifying the work, the infringing URL, and your contact details, with a statement that you are authorised to act. We operate a repeat-infringer policy and will remove infringing listings and terminate repeat offenders.
11. Availability and changes
We do not guarantee uninterrupted availability. We may modify, suspend or discontinue any part of the Site. We may update these Terms; material changes will be posted on this page with a revised date, and continued use after that constitutes acceptance.
12. Disclaimers and liability
Products are provided “as is” without warranty of fitness for any particular purpose. To the maximum extent permitted by law, our total liability arising out of or relating to the Site or any product is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including consumer rights you hold in your country of residence.
13. Governing law
These Terms are governed by the laws applicable at the registered seat of GameDesigners.online, without regard to conflict-of-law rules, and without depriving you of any mandatory consumer protection in your country of residence.
